I could argue that he is there under duress. He's just looking for a way out of the room while avoiding being shot. How did he end up in that crowd in the first place? Around all those Confederate flags? I could argue in court that he just got caught up in the wave of people and had no intent to die surrounded by all those racist crackers. He's the only guy who was there that day who has a defence.
